Dear Friends, Partners and Associates,

We have the pleasure to introduce to your attention the Annual Report on the activities of the Armenian Young Lawyers Association for 2010. It briefly refers to the organization, its current activities, projects and financial reports. We attach much importance to making the organization’s activities transparent and accessible for the interested individuals and entities, as well as to ensure transparency and reporting for the beneficiaries, members, partners, stakeholders and donor organizations, as this is the pillar and foundation for efficient activity of the organization. For these purposes the organization publishes and disseminates the Annual Report.

The year 2010 was rather productive for the AYLA. The organization implemented 5 divers project, during which the organization continued providing free legal aid services to the population of the Republic of Armenia through the network of its offices, as well as the newly opened and operating with USAID financial support Advocacy and Assistance Centers and Reception Centers including support in cases, which include corruption risks. This year, in addition to free legal services, AYLA provided free barrister’s services as well, which of course, is an invaluable support to the extremely vulnerable groups of the population. Rather extensive work was carried out aimed at dissemination of accessible information on their rights among the population. Attaching importance to struggle against corruption AYLA carried out successful activities seeking procedural and system level changes. The organization carried out considerable work aimed at raising the public awareness and for the development of professional skills of the young lawyers. It organized a number of training courses and carried out 3 republican and 1regional scientific conferences for the law students. The regional conference was organized by Gyumri office of the AYLA Shirak branch. The collection of best reports of the republican conferences shall be published and disseminated among the interested parties. The traditional “Philip C. Jessup International Law Moot Court Competition” for the law students was organized as well. The last year was also notable for the AYLA. The organization established partner relations with a number of governmental and local self governmental bodies, law enforcement bodies as well as similar international organizations through signing memorandums of understanding with them.

I would like to express my deepest gratitude to all AYLA members and staff, our supporters, colleagues, stakeholders, beneficiaries and donors for their support and assistance in our achievements. We appreciate everyone’s work and believe that their activities assist to achieve the desired results, and thus provide us opportunity to work with greater devotion.

Currently the Armenian Young Lawyers Association undertakes definite steps aimed at development of democracy in our republic and consolidation of the legal state. The organization shall further contribute its strength and activities to the protection of the rights and interests of the members of society, as well as to the development of the professional skills and capacity of the lawyers of new generation.

  1. INTRODUCTION

The Armenian Young Lawyers Association was established in 1995 in Yerevan. During 16 years of activities, the organization was highly appreciated by its beneficiaries, partners and stakeholders, and currently has its definite place in the legal field of the Republic.

Since its establishment, the organization determined its mission and established rather pretentious goals and objectives, and started to work in the legal and public fields of the Republic of Armenia, having the aim to protect the rights of the population, development of the young lawyers, and establishment of the civil society.

In result of rational work, the organization soon established partnership relations with a number of state, non-governmental, international, and foreign organizations, and started implementation of various projects derived from its strategic directions and aimed at achievement of its goals. In some years, the organization’s services became accessible nearly all over the republic due to the network of the AYLA offices, which operate in the Republic of Armenia Marzes. Currently the AYLA has six regional branches that are located in Yerevan, as well as in Gyumri, Vanadzor, Kapan, Gavar, and Tavush Marzes. In 2010, with USAID financial support, AYLA continued operating; the Advocacy and Assistance Centers in Aragatsotn, Kotayk, Vayots Dzor, Ararat and Tavush Marzes of the RA and established AACs and AARCs in Lori, Shirak and Syunik Marzes of the republic.

In 2003, having the aim to raise the efficiency of the projects directed to the development of law students, as well as to expand their involvement in AYLA activities and to raise the level of their legal consciousness, AYLA established its Law Students’ Division (LSD). The activities of LSD are aimed to facilitate introduction of the international legal experience and improvement of the quality and efficiency of the legal education in the law schools and law departments of the other institutes in the Republic of Armenia. AYLA possesses a rich legal library, and its services are available for young lawyers, as well as all interested individuals in Yerevan and in marzes. AYLA has elaborated and launched a bilingual official website www.ayla.am to disseminate information on the organization and to ensure the transparency of its activities.

The main directions of the AYLA activities are protection of human rights, raising the level of legal awareness among the population, assistance to the establishment and development of the Advocacy institute in Armenia, promotion of judiciary and legal reforms, as well as development and education of the lawyers of new generation and establishment of the civil society.

  • AYLA MISSION AND VALUES

The Mission of Armenian Young Lawyers Association is to develop a new generation of highly professional lawyers, having a modern outlook and moral values, as well as to promote the establishment of rule of law, and formation of the legal culture in the society.

The values, which the Armenian Young Lawyers Association has adopted since its establishment, are:

  • Modern legal culture based upon the heritage of centuries old Armenian values.
  • Legally educated society, which is aware of its rights.
  • Protected human rights.
  • Highly professional lawyers and advocates, possessing a new and modern methodology.
  • Powerful and a strong civil society.

 

  1. AYLA TEAM

Success of the Armenian Young Lawyers Association is explained with high professionalism of its core team, and knowledgeable and flexible young lawyers, advocates, and other specialists who share the mission and values of the organization. They continuously and with great devotion carry out activities, bring new breath to the structure and step forward with new undertakings and professionalism for the achievement of the Organization’s Mission. The AYLA team consistently works towards the development of its professional qualities and skills to be in conformity with the demands of the modern world. The team realizes the importance of the ideology and values of the structure and always relies on them during their work.

  1. COOPERATION

AYLA has established partner relations with over one hundred non-governmental, as well as with more than a dozen of international and foreign organizations. The Association cooperates with different state bodies, the RA Government, regional, municipal and rural government bodies, the National Assembly, the staff of the President of the Republic of Armenia, as well as with the institutes of judiciary system and other structures.

The Embassy of the United States of America in Armenia was founded in 1992. The Embassy’s assistance programs promote Armenia’s long-term economic development, sound social policies and democratic reform.

The U.S. Embassy is responsible for maintaining day-to-day relations between the U.S. and Armenian governments, and for providing consular services to citizens.

The United States Agency for International Development (USAID) is an independent federal government agency that receives overall foreign policy guidance from the Secretary of State and provides economic, social, development and humanitarian assistance around the world in support of U.S. foreign policy objectives.

For over a decade, USAID has been a leading donor agency in Armenia, managing approximately two-thirds of the total U.S. assistance program. Over this time, USAID/Armenia’s programs have evolved from humanitarian assistance towards promotion of long-term economic development, sound social policies and democratic reform.

USAID/Armenia works with the Armenian public, the Government of Armenia, non-governmental organizations, businesses, and other donors.

Casals & Associates, Inc. (Casals) is an international development and strategic communications firm delivering groundbreaking solutions to social, institutional and political challenges, and works globally addressing democracy and governance, rule of law and justice, conflict management and recovery, health and other urgent issues facing societies.

The Mobilizing Action Against Corruption (MAAC) Activity was a component of the U.S. development assistance program to the Republic of Armenia, which was implemented by Casals & Associates Inc., an international development and strategic communications firm aimed at reducing corruption in Armenia by the following means: providing Armenians with opportunities that would enable them to help combat corrupt practices that they encounter; changing social attitudes and behavior among youth and adults to help them become attuned to the consequences of corruption and more likely to oppose or confront corruption; and enabling systems-level changes to prevent or reduce corruption.

The Nederlandse Organisatie voor Internationale Bijstand, or Oxfam Novib for short, was set up on 23 March 1956. Oxfam Novib was intended to become an organization that would engage the entire Dutch population. That is why all the civic organizations and political parties of the day were invited to become members. In order to increase the effectiveness of its work, Oxfam Novib joined Oxfam International in 1994. Oxfam International is an alliance of 12 independent organizations that work together on the basis of the conviction that poverty and exclusion are unjust and unnecessary.

Oxfam Novib, a member of Oxfam International, is fighting for a just world without poverty. Together with people, organizations, businesses and governments, through projects and lobby, locally and internationally, in cooperation with counterparts in developing countries and their networks aimed at insuring Basic rights for everyone and enabling people to claim their basic rights. Oxfam Novib’s work is aimed at enabling poor people to claim their basic rights: Right to basic social services, Right to life and safety, Right to social and political participation, and Right to identity.

The Organization for Security and Co-operation in Europe (OSCE) Office in Yerevan started operations on 9 February 2000. The mandate of the Office is broad, covering all aspects of OSCE activities in the politico-military, economic and environmental, as well as human dimensions. The Office contributes to the development of democratic institutions in the country, strengthening civil society and promoting OSCE standards and principles.

The “LEGAL ALLIANCE” Law Firm was established in 1997 with the aim of providing quality legal services to its clients and becoming a leading firm in the legal market. The Firm has been developed dynamically since its inception and it now meets the demanding legal requirements of top domestic and international commercial firms. “LEGAL ALLIANCE” Law Firm is now a pioneering law firm in Armenia, providing accessible and highly qualified legal services to individuals and business entities. The Law Firm has a network of offices, which operate nationwide and provides access to its services in the RA provinces as well. “LEGAL ALLIANCE” Law Firm is a company providing comprehensive legal services to private individuals as well as businessmen. It works with major multinational corporations and financial institutions, as well as with a broad range of clients including the family and private businesses.

The Law Foundation of Armenia was founded in 2003. The main goals of the Foundation are to assist to the implementation of legal and judicial reforms in the Republic of Armenia, assist to the establishment and development of the advocacy institute in the republic, as well as to improve the professional skills and raise the role of advocates. It also supports to the establishment of the law schools and the law faculties of other institutes of RA, and promotes to the improvement of the quality and efficacy of legal education in the law schools and the law faculties of other institutes.

The International Law Students Association (ILSA) is a non-profit association of students and young lawyers dedicated to the study and promotion of international law. The Association joins the resources of all law schools and strives to make them accessible for all member organizations. Its history is closely linked with its flagship activity, the Philip C. Jessup International Law Moot Court Competition. Since its creation, ILSA has been an important influence in ensuring that future generations of law students learn the significance of international law. Currently through its programs and support, ILSA provides essential educational resources to future generations of lawyers and other international professionals worldwide, which will contribute to the development of world order and international law.

The European Young Bar Association (EYBA) is a non-profit making, multinational young lawyers association founded on 23 May 1993 in Prague. The group now represents the interests of over 200000 young lawyers and is the world’s largest young lawyers group. EYBA was established to encourage links between and to promote the interests and welfare of young lawyers throughout geographical Europe. AYLA joined The European Young Bar Association in 1998.

AYLA constantly consolidates its links with the partners, and strives to establish and promotes the establishment of new cooperation between AYLA and other organizations. The AYLA external relations are one of the assets of the structure. AYLA enjoys confidence among the partner organizations and this is a guarantee for consolidation of the links and establishment of new relationships.

AYLA attaches much importance and appreciates cooperation with Mass Media, which is indispensable for ensuring the efficiency and transparency of the organizations’ activities, as well as informing the beneficiaries. The Armenian Mass Media impartially covers all the events organized by AYLA.

  1. AYLA PROJECTS AND REALIZED ACTIVITIES

 

“My Right to be heard”: AYLA started implementation of this project funded by Oxfam Novib (Netherlands) in April 2009. In the framework of the project the socially vulnerable layers and insecure groups of the population, as well as people with limited access to legal aid received free legal advice services, and were provided free court representation.

The lawyers, law students and interested individuals were provided free legal and information resources. The project includes organization of the regular conference on urgent issues of justice and advocacy. In addition 30 (thirty) titles of information leaflets/pamphlets on fundamental and everyday human rights and the mechanisms for their protection were published and disseminated among the population having the aim to raise the level of legal consciousness of the people. In 2009 the AYLA Yerevan office and the regional branches organized public awareness seminars on fundamental and everyday human rights and the mechanisms for their protection.

“Operation of Advocacy and Assistance Center in Ijevan City of Tavush Marz”: AYLA implemented the project on from 1 October 2008 through July 2010. The Mobilizing Action against Corruption Activity project, funded by funds leveraged from the USAID, was aimed at establishing and operation of an Advocacy and Assistance Center (AAC) in Ijevan city of Tavush Marz of the RA. The lawyers of the AAC provide free legal advice services to the population of the Marz in particular providing them opportunity for reporting corruption and directing complaints to GOAM agencies; provide legal counsel to support their claims against the government and intensify public focus on how the Public Prosecutor and the courts handle corruption cases; identify shortcomings in legislation addressing corruption and in implementing legislation and decrees; identify corrupt activities in GOAM institutions, based on first-person reports of victimization. The advocates involved in the framework of the project provided free legal representation for the citizens on civil, administrative and criminal cases. Training of trainers on anti-corruption issues, including the citizens’ rights with respect to corruption and the mechanisms how to protect these rights was organized. Public awareness seminars about anti-corruption issues, including the citizens’ rights with respect to corruption and the mechanisms how to protect these rights were organized as well.

Establishment and Operation of Advocacy and Assistance Centers and Reception Centers in Hrazdan, Yeghegnadzor, Ararat, Ashtarak, Aparan, and Talin Cities”: AYLA implemented the project from April 2009 through July 2010. The Mobilizing Action against Corruption Activity project, funded by funds leveraged from the USAID, was aimed at establishing and operation of 3 (three) Advocacy and Assistance Centers in Aragatsotn, Kotayk, and Vayots Dzor Marzes of the RA and 3 (three) Advocacy and Assistance Reception Centers in Ararat, Talin and Aparan Cities. The lawyers of the AACs and AARCs provide free legal advice services to the population of the Marz in particular providing them opportunity for reporting corruption and directing complaints to GOAM agencies; provide legal counsel to support their claims against the government and intensify public focus on how the Public Prosecutor and the courts handle corruption cases; identify shortcomings in legislation addressing corruption and in implementing legislation and decrees; identify corrupt activities in GOAM institutions, based on first-person reports of victimization. The advocates involved in the framework of the project provided free legal representation for the citizens on civil, administrative and criminal cases. During the project implementation special attention was paid to raising the anticorruption awareness and education. In this relation 40 (forty) titles of information leaflets/flyers on anti-corruption issues, including the citizens’ rights with respect to corruption and the mechanisms how to protect these rights were published and disseminated among the population. Training of trainers on anti-corruption issues, including the citizens’ rights with respect to corruption and the mechanisms how to protect these rights was organized. Public awareness seminars about anti-corruption issues, including the citizens’ rights with respect to corruption and the mechanisms how to protect these rights were organized as well.

Establishment and Operation of Advocacy and Assistance Centers in Yerevan, Vanadzor, Kapan, Hrazdan, and Ashtarak and Reception Centers in Ararat, Talin, Aparan, Gyumri, Ijevan and Yeghegnadzor Cities”: AYLA started implementation of project in August 2010. The Mobilizing Action against Corruption Activity project, funded by funds leveraged from the USAID, was aimed to continue further operation of the Advocacy and Assistance Centers and Reception Centers operated by the AYLA in Ijevan, Hrazdan, Ashtarak, Yeghegnadzor, Ararat, Talin and Aparan Cities, and to establish and operate anticorruption centers and reception centers in Yerevan, Kapan, Vanadzor, and Gyumri Cities. The lawyers of the AAC and AARCs provide free legal advice services to the population of the Marz in particular providing them opportunity for reporting corruption and directing complaints to GOAM agencies; provide legal counsel to support their claims against the government and intensify public focus on how the Public Prosecutor and the courts handle corruption cases; identify shortcomings in legislation addressing corruption and in implementing legislation and decrees; identify corrupt activities in GOAM institutions, based on first-person reports of victimization Yerevan, and in Syunik, Lori, Kotayk, Aragatsotn, Shirak, Tavush, Vayots Dzor and Ararat Marzes of the RA. In addition, the centers publicized information on how the courts preliminary inquiry bodies consider the corruption cases revealed in Yerevan, as well as in Syunik, Lori, Kotayk, Aragatsotn, Shirak, Tavush, Vayots Dzor and Ararat Marzes of RA. Types of corrupt activities that existed in the state and local government bodies in Yerevan and target Syunik, Lori, Kotayk, Aragatsotn, Shirak, Tavush, Vayots Dzor and Ararat Marzes were identified based on the complaint provided by the victim of corruption. Cooperation on partnership basis was established with the state and local government bodies, including with the bodies that implement justice, as well as the bodies and organizations that support to implementation of justice. This cooperation was aimed to introduce corrective measures and system level reforms that are directed to decrease the corruption. The basic information and data collected by the AACs and AARCs in target Marzes was used to promote involvement of youth and adults in struggle to curb corruption.

“The 2010 Philip Jessup International Law Moot Court Competition”

Students from the law schools and law departments of other institutes participated in the 2010 Jessup Competition. The winner of the Armenian National Round of, the students’ team of the Russian-Armenian (Slavonic) University took part in the International Round of the 2010 Philip C. Jessup International Law Moot Court Competition in Washington on March 2010.

This year The Law Foundation of Armenia, the Armenian Young Lawyers Association and “LEGAL ALLIANCE” Law Firm, were co-organizers of the Competition. The National Round was organized with the financial support of the US Embassy in Armenia. The Judicial Department of the Republic of Armenia traditionally assisted to organization of the Competition, and provided Court rooms.

In 2010 the National Administrator of the Armenian Rounds of Jessup Competition conducted meetings with the students of the law departments of the RA Universities and institutes in Yerevan and in the Marzes aimed to increase the interest of the students and to attach importance to the Competition. During the meetings the National Administrator introduced to the attention of the students information on the Competition, and provided printed materials. They also referred to the problems that hinder the law students to participate in the Competition and tried to find solutions.

Seventh Scientific Conference for the Law Students “Advocacy: Challenges and Current State in the Republic of Armenia”

The Oral Round of the Seventh Scientific Conference for the law students “Advocacy: Challenges and Current State in the Republic of Armenia” for the law students, which was organized jointly by the Armenian Young Lawyers Association, The Law Foundation of Armenia and “Legal Alliance” Law Firm took place in the Central Office of the Armenian Young Lawyers Association in Yerevan on 26 November 2010.

The Conference is already an established tradition, which has the aim to raise the level of knowledge of the law students in the advocacy sphere; to promote implementation of serious research activities by the students; and contribute to raising the role of the advocacy institute in the Republic of Armenia. It provides opportunity to hear the new ideas and solutions suggested by the lawyers of the new generation as well.

The Conference consists of two rounds: written and oral. 34 students from the law schools of Yerevan and from the regions had applied for participation in the conference. 30 applicants introduced their reports in time. In compliance with the official rules of the conference, the authors of the best 10 reports were authorized to take part in the final, oral round.

Gohar Gevorgyan, 1st year student of Magistrate from the law department of Yerevan State University won the prize for the “Best Written Report” of the Scientific Conference for the law students “Advocacy: Challenges and Current State in the Republic of Armenia.” Madlena Margaryan, 2nd year student of Magistrate from Armenian-Slavonic University was recognized the third in the oral round. Gohar Gevorgyan, 1st year student of Magistrate from the law department of Yerevan State University won the second prize. Anahit Harutyunyan, 1st year student of Magistrate from the law department of Yerevan State University was awarded the “Special Prize” of the scientific conference established by the AYLA President. Meline Fereshatyan, 2nd year student of Magistrate from Armenian-Slavonic University was recognized “The Best Oralist” and the winner of the Competition. The winners received valuable prizes and corresponding certificates. Participants of the written round of the Conference received participation certificates as well. The oral round of the conference was broadly covered by mass media.

 

“Current Ways of Corruption Appearances and Combating Corruption in the Changing World” Republican Scientific Conference for Law Students

The Oral Round of the Scientific Conference for the law students “Current Ways of Corruption Appearances and Combating Corruption in the Changing World” took place in the Central Office of the Armenian Young Lawyers Association in Yerevan at 10:30a.m., on 9 December 2010.

By Resolution 58/4 of 31 October 2003, the UN General Assembly designated 9 December as International Anti-Corruption Day. The Resolution was aimed to promote importance of the United Nations Convention against Corruption in preventing and combat corruption. On the assumption of the fact that organization of events aimed at educating the youth and young lawyers of the RA attaching importance to the existing problems of corruption and the international experience on combating the corruption is one of the main direction of the Activities of Armenian Young Lawyers Association and Yerevan Advocacy and Assistance (Anticorruption) Center, they organized a Scientific Conference for the law students “Current Ways of Corruption Appearances and Combating Corruption in the Changing World.” The Conference consists of two rounds: written and oral. 34 students from the law schools of Yerevan and from the regions had applied for participation in the conference. 10 applicants introduced their reports in time. In compliance with the official rules of the conference, the authors of the best 7 reports were authorized to take part in the final, oral round. The participants introduced their papers, which referred to the existing corruption problems as well as revealed the existing shortcomings and omissions in legislation and suggest their ideas and solutions. Kristina Gasparyan, 3rd year student of Gyumri Branch of European Regional Educational Academy won the prize for the “Best Written Report” of the Scientific Conference for the law students “Current Ways of Corruption Appearances and Combating Corruption in the Changing World.” Garegin Salakhyan, 5th year student of St. Petersburg Institute of Foreign Economic Relations, Economics and Law (IFRAEL) Yerevan Branch was recognized the third in the oral round. Gayane Arshakyan, 3rd year student of Yerevan Northern University won the second prize and was recognized the winner of oral round and “Best Orlaist” of the Conference. Garegin Salakhyan, 5th year student of St. Petersburg Institute of Foreign Economic Relations, Economics and Law (IFRAEL) Yerevan Branch was awarded the “Special Prize” of the scientific conference established by Mr. Vache Kalashyan, President of Union of Armenian Government Employees.

Kristina Gasparyan, 3rd year student of Gyumri Branch of European Regional Educational Academy was recognized the winner of the Competition. The winners received valuable prizes and corresponding certificates. Participants of the written round of the Conference received participation certificates as well.

 

Scientific Conference for the Law Students “The Role and Importance of the Decisions of European Court of Human Rights in the Legal System of the Republic of Armenia”

The final Oral Round of the Conference for the Law Students “The Role and Importance of the Decisions of European Court of Human Rights in the Legal System of the Republic of Armenia” for the law students, was held on 10 December 2010 in the Central Office of the Armenian Young Lawyers Association.

In 1950, all States and interested organizations were invited by the UN General Assembly to observe 10 December as Human Rights Day (resolution 423(V)). The Day marks the anniversary of the Assembly’s adoption of the Universal Declaration of Human Rights in 1948. On this assumption, the Armenian Young Lawyers Association NGO, with financial support of Dutch Stitching OXFAM NOVIB Organization organized the Republican Conference for the Law Students “The Role and Importance of the Decisions of European Court on Human Rights in the Legal System of the Republic of Armenia,” which was dedicated to the 60th anniversary of the adoption of the Universal Declaration of Human Rights.

The Conference consists of two rounds: written and oral. 14 students from the law schools of Yerevan and from the regions had applied for participation in the conference. 8 applicants introduced their reports in time. In compliance with the official rules of the conference, the authors of the best 5 reports were authorized to take part in the final, oral round. The participants introduced their papers, which referred to the precedents of the European Court of Human Rights, the ECHR rulings against the Republic of Armenia and the procedures of their implementation. Shushanik Tadevosyan, 3rd year student of European Regional Educational Academy was recognized “The Best Oralist” and the winner of the oral round of the competition. She was awarded the third prize of the Conference. Anahit Harutyunyan, 1st year student of Magistrate from the law department of Yerevan State University was awarded the prize for the “Best Report” and won the second prize of the Conference.

Gevorg Hakobyan, 2nd year student of Magistrate, of the International Scientific and Educational Center of the National Academy of Sciences of the RA was announced the winner of the Republican Conference for the Law Students “The Role and Importance of the Decisions of European Court on Human Rights in the Legal System of the Republic of Armenia.”

 

Regional Scientific Conference “Implementation of the Republic of Armenia 2009-2012 Anti-Corruption Strategy and Implementation Action Plan as an Effective Tool to curb Corruption”

The final Oral Round of the Regional Scientific Conference for the law students “Implementation of the Republic of Armenia 2009-2012 Anti-Corruption Strategy and Implementation Action Plan as an Effective Tool to curb Corruption” took place in Gyumri Advocacy and Assistance Reception Center on 17 December 2010. On the assumption of the fact that organization of events aimed at educating the youth and young lawyers of the RA attaching importance to the existing problems of corruption and the international experience on combating the corruption is one of the main direction of the activities of Gyumri Advocacy and Assistance Reception Center operated by the Armenian Young Lawyers Association, Gyumri AARC had organized the above mentioned event.

The Conference consisted of two rounds: written and oral. 6 students from the law schools of Shirak Marz had applied for participation in the conference. 5 applicants introduced their reports in time. In compliance with the official rules of the conference, the authors of these 5 reports were authorized to take part in the final, oral round. The participants introduced their papers, which referred to the 2009-2012 Anti-Corruption Strategy, the existing corruption problems, and suggest their ideas and solutions of the problems. Anna Martirosyan, 4th year student of Gyumri Branch of International Educational Academy won the prize for the “Best Written Report” of the Regional Scientific Conference for the law students “Implementation of the Republic of Armenia 2009-2012 Anti-Corruption Strategy and Implementation Action Plan as an Effective Tool to curb Corruption.” She was recognized the third in the oral round of the Regional conference as well. Lawyer Ara Gharagyozyan won the second prize. Lala Hovhannisyan, 2nd year student of Gyumri Michael Nalbandyan State Pedagogical University was recognized the winner of the Competition and was awarded the prize “Best Orlaist” of the Scientific Conference.

AYLA acquires New Partners: Partnership acquires Legal Basis

In 2010 AYLA worked actively to implement its strategic objectives aimed at establishing cooperation with the state and local government bodies.

In particular, having the aim to establish practical relations with the local self government and regional government bodies, the Armenian Young Lawyers Association signed Memorandums of Understanding in Tavush Marz: with Tavush regional administration, municipalities of Ijevan, Dilijan, Berd, Noyemberyan and Ayrum cities, and with administrations of Bagratashen, Tavush, Haghartsin and Aygehovit villages. In Vayots Dzor Marz of the RA: with Vayots Dzor regional administration, municipalities of Yeghegnadzor, Vayk and Jermuk cities. In Aragatsotn Marz of the RA: with Aragatsotn regional administration, municipalities of Ashtarak, Talin and Aparan cities. In Kotayk Marz of the RA: with Kotayk regional administration and municipality of Hrazdan city. In Ararat Marz of the RA: with Ararat regional administration, municipalities of Ararat Masis and Vedi cities.

The main objective of Memorandums of Understanding are to promote prevention of corruption and reduction of corruption risks in the mentioned marzes, assist to raising efficiency of struggle against corruption, raise the level of awareness of the population on the need to struggle against the corruption, promote procedural and systems-level changes of legislation, which includes corruption risks, etc.

AYLA plans to reinforce and legally consolidate its cooperation with other state, local and law enforcement bodies in future as well.

Evidence of efficiency of Memorandums of Understanding is the fact that after signing such Memorandums between the AYLA and the above mentioned bodies, and in the framework of the rights and obligations vested under these Memorandums, the AACs registered rather solid results in solving the legal problems of the citizens in these institutions.

Presentation of the Bilingual Report on Findings of Public Monitoring conducted within the Framework of the Multi-Component Monitoring in the Notary Offices Project

In April – November 2009, the AYLA implemented Multi-Component Monitoring in the Notary Offices Project, and published the bilingual report on the results of public monitoring.

Presentation of the Report on Findings of Public Monitoring conducted within the Framework of the Multi-Component Monitoring in the Notary Offices Project took place on 30 June 2010 in Vivaldi Room of Golden Tulip Hotel Yerevan.

Mr. Karen Zadoyan, AYLA President, Mr. Armen Gevorgyan, RA Vice-Prime Minister, RA Minister of Territorial Administration, Mr. Gevorg Danielyan, RA Minister of Justice, Mr. Carel Hofstra, the Deputy Head of the OSCE Office in Yerevan, Ms Alvard Melkonyan, President of the Notary Chamber of the RA greeted the participants and opened the presentation ceremony with opening remarks.

Representatives from the Notary Chamber of the RA, notaries public, representatives from the National Assembly of the RA, Head of the staff of the RA prosecutor’s office, Head of the Control Service of the President of the Republic of Armenia, representatives of the Control Chamber of the RA and the RA Judicial Department, as well as representatives of international and non-governmental organizations, project observers, mass media, etc. attended the presentation as well.

Objective of Multi-Component Monitoring in the Notary Offices Project was to reveal the gaps and possible corruption risks that exist in the sphere of notary services.

The RA Vice-Prime Minister emphasized the importance of realization of such monitoring programs, and especially noted that of the “Comprehensive Monitoring of Notary Public Offices Project” as the first such project. He also mentioned that the monitoring was really comprehensive as it attended all aspects of the notary sphere including the office premises up to the quality of provided services, the citizen’s opinions and legal regulations.

A group of recommendations included in the report was incorporated in the package of legislative initiatives of the Government.

 

Membership to Coordination Council of Armenian National Platform of EU Eastern Partnership Civil Society Forum

On 7 June 2010 the Armenian Young Lawyers Association was nominated and elected member of Coordination Council of Armenian National Platform of EU Eastern Partnership Civil Society Forum.

The goal of CSF is dissemination of EaP ideas; harmonization of solutions of domestic problems of EaP target countries   EU standards; ensuring participation and awareness of all layers of the population in EaP developments. In addition, CSF is aimed at joining the societies of six EaP member countries; making them predictable to each other in recommending issues aimed at democratic reforms and in search for their solution.

CSF has 4 (four) thematic platforms, with the following range of activities: 1. Democracy, human rights, good governance and sustainability, 2. Economic integration and convergence with EU policies, 3. Environment, climate change and energy security,  4. Contacts between people, in  particular in the spheres of education, culture and youth issues and visa simplification and deregulation process.

AYLA is involved and works in Democracy, human rights, good governance and sustainability working group. In this framework, Mr. Karen Zadoyan, President of Armenian Young Lawyers Association participated in the 2nd Session of Eastern Partnership Civil Society Forum was held in Berlin, Germany on 18-19 November 2010. Representatives of over 150 civil society organizations from the Eastern Partnership Civil Society member countries participated in the work of the Forum. Members from about 100 different structures of the European Union and civil society organizations of the EU member countries attended the Forum as well.

At the 2nd Forum of ANP of EU Eastern Partnership Civil Society members that took place on 25 December in Yerevan, Mr. Karen Zadoyan was nominated and elected member of Coordination Council of Armenian National Platform of Eastern Partnership Civil Society Forum.

 

Conference of Anticorruption Centers of the Southern Caucasus in Tbilisi

On 28 through 30 July 2010 a conference of Anticorruption Centers of the Southern Caucasus organized by the USAID Mobilizing Action against Corruption (MAAC) Activity was held in Tbilisi. Around 25 representatives from Armenia, Georgia and Azerbaijan, as well as from international organization attended the conference. The main objective of the conference was to exchange the gained experience, introduction of the legal practice and realized activities of the AACs aimed to cub corruption. The participant organizations introduced their recommendations and ideas with regard to establishment of a network of anticorruption centers, which shall promote to consolidation of the activities of the cooperation network established during the work of the conference.

 

Legal Aid: Linking and Learning workshop in Tbilisi

The next working meeting “Legal Aid: Linking and Learning workshop,” took place in Tbilisi, the capital city of Georgia as well. It was organized by Oxfam Novib (Netherlands) in cooperation with Georgian Young Lawyers Association NGO and was held on 13 through 17 September 2010. Representatives from non-governmental organizations from Georgia, Armenia, Ukraine, Azerbaijan, Kyrgyzstan, and Uzbekistan, as well as foreign experts and representatives of Oxfam Novib attended the workshop. Armenian Young Lawyers Association was invited to participate in this meeting as one of the respected and professional organization working in the legal sphere as well. Lawyers Miss Syuzanna Soghomonyan, Assistant to the AYLA President and Miss Gayane Gevorgyan, Head of the AYLA Shirak Branch represented AYLA. The workshop was aimed to establish a cooperation network between the participant non-governmental organizations, which would undertake activities directed to establish links among the organizations working in the legal field, exchange of experience in good practice, and mutual support. The main objective of this meeting was to establish a cooperation network, which will involve its members in the process of implementation of the goals and objectives of coalition of NGOs for the sake of each organization and its beneficiaries.

AYLA Members participated in the 14th International Anti-Corruption Conference

The 14th International Anti-Corruption Conference was held in Bangkok Thailand on 10-13 November 2010. Two representatives of the AYLA, Mr. Marat Atovmyan, Head of Yerevan Advocacy and Assistance (anti-corruption) Center, which is operated by the AYLA, and Mr. Karen Zadoyan, President of the Armenian Young Lawyers Association NGO attended the conference as well. Participation of the latter was supported by USAID/Armenia. Prime Minister of Thailand, the Minister of Justice, the President of the National Anti-Corruption Commission of Thailand, as well as heads of different international organizations attended the opening of the Conference. Around 1500 participants from almost all countries of the world as well as representatives of international organizations participated in the Conference. The participants discussed the issues of corruption occurrences that exist in spheres of peace and security, natural resources and energy market, trafficking, business, justice, as well as the issues referring to international crime, good governance and the means of combating the corruption. During the Conference Mr. Marat Atovmyan met in the interview with Ms Weitlong Li-in, Director of Democracy and Law Publishing House of China. In their conversation they referred to the issues of corrupt occurrences and the risks that exist in the spheres of education and justice. Mr. Karen Zadoyan and Mr. Marat Atovmyan met with the representatives of different organizations as well. During these meetings they discussed the opportunities for possible cooperation as well as the issues of combating corruption.

AYLA Members visited the Lawyers Council of Thailand

On 11 November 2010, Mr. Karen Zadoyan, President of the “Armenian Young Lawyers Association” NGO and Mr. Marat Atovmyan, Head of Yerevan Advocacy and Assistance (anti-corruption) Center, which is operated by the AYLA, who participated in The 14th International Anti-Corruption Conference, which was held in Bangkok Thailand on 10-13 November 2010, visited the Lawyers Council of Thailand. AYLA representatives met with Mr. Jesada Anucharee, Vice-President on Policy and Planning, and Mrs. Suwannee Sirivejchapan Vice President of Foreign Affairs of The Lawyers Council of Thailand. The hosts introduced the structure of the Lawyers Council of Thailand, its mission and activities. Mr. Zadoyan and Mr. Atovmyan in their turn provided information on the AYLA, its activities and implemented projects. After the meeting the hosts showed the office of the Lawyers Council of Thailand to the guests, so that the latter had opportunity to see the building and organization of work process. The parties agreed to deepen cooperation among their organizations in future.

 

Activities of the AYLA Cultural and Sport Clubs in 2010

The AYLA Cultural and Sport Clubs continued their activities in 2010 as well. Various events that are organized systematically assist to extension and consolidation of their membership. AYLA staff, members, volunteers and partners actively participated in the activities of the club this year as well. In 2010 the AYLA Cultural Club initiated and organized visits to splendid historical and cultural sites in Tavush and Aragatsotn Marzes. In particular they visited Tegher Monastery (XIII century) and Amberd Monastery Complex (X-XIII centauries) in Aragatsotn Marz, as well as Lake Parz Litch, Makaravank Monastery, a medieval (XIII century) architectural church complex on the slope of Paytatap Mountain, Hagartsin Monastery Complex (X-XIII centauries), Jukhtak Monastery Complex of 11-12th centuries.

AYLA Sport Club in its turn organized football and other games for its members during the year as well.

 

  • SUCCESS STORIES

In 2010 AYLA implemented projects “Operation of Advocacy and Assistance Center in Ijevan City of Tavush Marz,” “Establishment and Operation of Advocacy and Assistance (Information) Centers and Reception Centers in Hrazdan, Yeghegnadzor, Ararat, Ashtarak, Aparan, and Talin Cities,” and “Operation of Advocacy and Assistance ((Information)) Centers and Reception Centers in  Yerevan, Vanadzor, Kapan, Gyumri, Ijevan, Hrazdan, Yeghegnadzor, Ararat, Ashtarak, Aparan, and Talin Cities” funded by the USAID MAAC Activity, as well as project “My Right to be heard” funded by Oxfam Novib (Netherlands), which contained component of struggle against corruption and had achieved certain success in the protection of human rights and interests. Below are some success stories of the AYLA Branches and Assistance Centers operated by the AYLA in the framework of these projects.

  1. AYLA Gegharkunik Branch Office

Ms Yelena Muradyan, teacher of Russian in Gavar school faced a big problem when she decided to sell her car. The problem was that the car belonged and was registered in the name of her mother, Sonya Shanoyan, who had died 8 years ago. However Yelena had not received her mother’s certificate of death. Yelena had applied to Gavar regional department of Civil Acts Registration Office with request to provide her mother’s death certificate. But the department refused to provide such certificate and provided certificate of denial. Irritated Yelena applied to the AYLA Gegharkunik Branch office for support and told her problem. To solve the problem the AYLA lawyer first provided oral consultancy and advised that in case when the death certificate is missing the individual shall provide to the Civil Acts Registration Office the court decision in force that proves the fact of death. Further the lawyer of Gavar office prepared an application to the Court of General Jurisdiction of Gavar with request to confirm the fact of the death, which was sent to the court accompanied with all the necessary documents requested by law. After some time Ms. Muradyan visited AYLA office in Gavar and expressed her gratitude for the efficient work of the Branch office. In a month, based on the court decision Yelena received her mother’s certificate of death, after which she could sell the car.

  1. Yerevan Advocacy and Assistance Center

On 26 September 2010, the inspectors of the Road Police stopped the car of Yerevan citizen Mr. Victor Melkumov on the crossroad Nar-Dos and Khorenatsi streets and insisted that he had violated the traffic rules and crossed the road under the red light and at the same time hindered the pedestrians crossing the street. The inspectors threatened the driver and told him that they should impose a fine of 30000 AMD for this breach. Professor Melkumov insisted that he had not committed any breach and had crossed the road under the green light. After that the inspectors suggested him to pay at least 3000 AMD to them and to leave the place. At that moment Mr. Marat Atovmyan, head of Yerevan AAC was passing nearby and noticed the incident. He approached the arguing people to help them to solve the problem. Mr. Atovmyan asked the Road Police to show the record of the breach if they had recorded it on their radar. The inspectors denied this saying that they had no record as the radar was not switched on. Mr. Atovmyan suggested the inspectors to write a note of the fine of 30000AMD, which they further shall argue in the court. The irritated inspectors refused and said that problem could be solved “in another way.” However in result of Mr. Atovmyan’s consistency the inspectors returned the driver’s documents and left. The people who had gathered here expressed their gratitude and informed that the same inspectors had stopped another car just some time before that with the same claim. The moral support of the citizens is the evidence that the public in our country does no trust in the state bodies and especially the police.

 

  1. Advocacy and Assistance Center of Tavush Marz

In February 2009, Mrs. Lusine Voskanyan, citizen of Ijevan applied to the AAC of Tavush Marz of the RA and informed that she was registered in the list of the citizens of Ijevan city who need flat. Mrs. Voskanyan lived in the dormitory of the former school #4 of Ijevan city. Currently she was removed from the mentioned list and was dismissed without the corresponding court decision from the room of the dormitory where she lived temporarily. The AAC studied all documents of the case provided by L. Voskanyan, including the document dated to 27.09.1999, which witnessed that she was registered in the list of the citizens of Ijevan city who need flat. Yet, by unknown reasons her named was removed from this list. On 2 March 2009 the AAC sent a notice to Ijevan City Administration with a request to provide information on the number of the citizens registered in the list of individuals who need flat since 1999, how many people from the list received flats, and whether Lusine Voskanyan was included in that list. The City Administration neglected the notice. After several attempts and reminders to the City Administration to provide the requested information, on 09.11.2009 the AAC filed an appeal to the Administrative Court of the RA with a claim on the request to provide information. Only after that the AAC received a reply from Ijevan City Administration that Mrs. Lusine Voskanyan was not among the persons who need flat because she was provided a land (ground area). After receiving this reply the AAC involved an advocate who prepared an application which introduced the detailed information that Mrs. Voskanyan had provided the documentation of the ground area, which shows that the land was provided to her on competitive basis with the right to construction (built constructions). At the same time the ground area was provided to her on the basis of long term lease, with the right to built constructions of public need (importance). However the mentioned contract did not solve the living problem of the citizen, because she was not authorized to build a house. In addition under such conditions, the lease contract was suitable for the physical person carrying out entrepreneur activities or for a juridical person. At the same time the applicant did not have enough financial means to realize construction activates. Further, according to the RA Civil Law the lender is entitled to revise the costs of the lease contract at any time, and the lessee cannot interfere in deciding the amount of the sum, and later in case of reviewing the amount of the sum and not returning it, he may lose the ground area (the land).  This once and again proves that the issue of the flat (of living) of the individual is not solved by the contract, as the contract may be terminated at any time in case of not paying the sum. Thus there will be a need to include the citizen in the list of people who need flat and to provide a flat which has suitable living conditions. Thereby in result of an in-depth study of the legal acts, and involvement of experienced specialists, as well as the consistent behavior by the AAC, Mrs. Lusine Voskanyan was restored in the list of citizens who need flat. In addition, the Mayor of Ijevan city in his turn undertook responsibility and promised to solve the housing problem of the applicant in the framework of house building projects realized in Ijevan City with support of different international organizations and funds. He promised to do this in case of the first opportunity and informed about this to the AAC of Ijevan Marz of the RA in his notice dated 25 March 2010.
It is really remarkable that this is the second serious achievement after signing of the Memorandum of Understanding between the Advocacy and Assistance Center of Tavush Marz of the Republic of Armenia, which is operated by the Armenian Young Lawyers Association NGO, and Ijevan City Administration on 25 February 2010.

 

  1. Advocacy and Assistance Center of Kotayk Marz

On 12.01.2010, Mr. N. Alexanyan from Vanatur district of Hrazdan city applied to Kotayk Marz AAC. He was concerned with the fact of negligence and carelessness of the law enforcement bodies towards the offence committed against him. The problem was that Alexanyan’s family had had a civil dispute with their neighbor family referring to the land plot, and had applied to the Court of General Jurisdiction of Kotayk Marz with a request to consider this dispute. On 24.09.2009 the judge who considered the case had visited the disputable land area in the framework of the Civil Case. According to the information of the citizen, during the examination of the location the judge had stated that the land belonged to the Alexanyan family. The neighbor’s sons, who were working in the police, were concerned with the fact and in the presence of the judge the secretary of the court and of the other neighbors, attacked and beat up Alexanyan. The Judge had registered the fact and imposed disciplinary fine of 100000 AMD upon the mentioned persons. On 29.09.2009 Mr. Alexanyan wrote letter of complaint to the Chief of Police of the Republic of Armenia. On 09.10.2009 the Staff of The RA Police demanded and received from the judge the protocol referring to the fact of the occurrence. Further, the police representatives took explanations and evidences from Alexanyan and the witnesses about the case. However, by the moment when Alexanyan applied to Kotayk AAC, there was no reply from the police. There was no response for a rather long period of time. On 1 February 2010, the head of Kotayk AAC compiled an application to Mr. Alik Sargsyan, Chief of Republic of Armenia Police, as well as supported the beneficiary to prepare an application to the Ombudsman of the RA.  It is due to mention that the Court of General Jurisdiction of Kotayk Marz had made a decision in favor of Mr. Alexanyan. The Respondent appealed the decision in the Civil Court of Appeal of the RA. The reply of the Staff of The RA Police to the above mentioned application was received on 15 February 2010, which said that the policemen, who committed the illegal act (beat up) against Mr. Alexanyan, shall be called to disciplinary liability and the case shall be sent to the Special Investigation Department for further examination.

Parallel to this, on 12.02.2010 the reply from the office of Ombudsman of the RA was received as well. The reply said that the case was accepted for consideration. Further, during consideration of the case, advocate A. Hakobyan was involved in the process as well in order to provide complete support to the citizen. A. Hakobyan participated in the court hearing in the Civil Court of Appeal of the RA, and filed a motion to delay the court hearing in order to get acquainted with the materials of the case. During this period N. Alexanyan was invited to the Special Investigation Department, which was examining the case. Mr. Alexanyan, accompanied by his advocate A. Hakobyan, as well as the two policemen who had insulted the citizen came to the Special Investigation Department to provide evidences.

After the interrogation the situation changed radically. The investigator tried to reconcile the opponents. Further the representatives of the respondent, including the policemen who had committed the offence, accepted the correctness of the citizen in the land issue and asked (even begged) him to withdraw the complaint from the Special Investigation Department. Eventually, in early March, they signed a reconciliation agreement with N. Alexanyan and his family, where they renounced from the claims upon the land, and waived their claim submitted to the Administrative Court, where they intended to provide new evidences in order to win the case in the Civil Court of Appeal. On 8 April 2010, the Civil Court of Appeal of the RA approved the Reconciliation Agreement

Actually, in result of consecutive and principle work of Kotayk AAC the delinquent policemen were called to responsibility and at the same time land ownership right of N. Alexanyan and his neighbors were protected. And what is even more important the confidence and trust of Mr. Alexanyan and his family members towards the law and the law enforcement bodies were restored.

Free legal advice and advocacy services

In 2010, AYLA offices, as well as AACs and AARCs operated by the organization provided free legal advice services and court representation for the representatives of the vulnerable groups of the society. Altogether 9823 people applied for AYLA services. 9744 or 99.1% were physical persons and 79 or 0.9 % were juridical persons. 6001 beneficiaries or 61.1% were female and 3822 beneficiaries or 38.9% were male.

  1. AYLA BOARD

The Board of the Organization is considered to be the governing body of the Organization in-between the General Assemblies. The composition of the Board is determined at the General Meeting of AYLA members, which is held every two years. AYLA held its IX General Meeting on 4 December 2010.
