The President of the ALA presented Proposals on the Conceptual Report of the Prosecutor’s Office at the Sitting of the Professional Committee on Constitutional Reforms

On 4 September, the regular sitting of the Professional Committee on Constitutional Reforms chaired by the Chairman of the Committee Yeghishe Kirakosyan took place.

According to the agenda, Legal Scholar Arthur Ghambaryan, member of the Committee, made a conceptual report entitled “Constitutional Status of the Investigative Bodies of the Prosecutor’s Office”.

President of the Armenian Lawyers’ Association, Member of the Professional Committee Karen Zadoyan, also attended the meeting and presented the ALA proposals on the “Constitutional Status of the Investigative Bodies of the Prosecutor’s Office”.

The proposals refer to:

  1. Assigning the function of carrying out investigative actions to the RA Prosecutor’s Office according to the RA Constitution;
  2. The term “exceptional cases” regarding the submission of a claim for the protection of the state interests of the Republic of Armenia;
  3. The procedure and terms of the election of the Prosecutor General of the Republic of Armenia;
  4. Envisaging a complicated procedure for granting immunity to the RA Prosecutor General or initiating criminal prosecution against him;
  5. Constitutional settlement of the grounds for termination of the powers of the RA Prosecutor General;
  6. Initiation of criminal prosecution (involving a person as an accused), sending the case to court, termination of criminal prosecution as a constitutional regulation of the exclusive function of the Prosecutor’s Office;
  7. The Anti-Corruption Investigation Body;
  8. The Anti-Corruption Prosecutor’s Office.

During the discussion of the organizational issues of the sitting, Karen Zadoyan informed that he had sent to the Committee the concepts of “direct democracy of the Constitutional Anti-Corruption Body/Bodies” developed by the expert group of the Armenian Lawyers’ Association. The President of the ALA proposed to include the above-mentioned concepts and the discussion of the conceptual provisions in the agendas of the forthcoming sittings of the Committee.
