Dear Friends, Partners and Supporters,

With great love, pride and responsibility, I present to you the 2018 annual report (hereinafter referred to as the report) of the “Armenian Lawyers’ Association” NGOs activities, where the summaries of the activities of our organization and the financial results of finished and ongoing projects are presented. It is very important for us to adhere to the principles of good faith of the structure before our beneficiaries, members, partners and donor organizations, therefore we publish a report for each year.
Throughout 2018 the ALA continued to implement the “Commitment to Constructive Dialogue” project, in the framework of which it cooperated with RA State Bodies, had meetings with the competent bodies of 9 target spheres defined by the program, participated in the process of designing, processing and publicly monitoring a number of RA strategic documents and in public oversight. Moreover, the “Armenia: Promoting Anti-Corruption Conduct and Reform” Project was very important to us and will last until October 1, 2019. We are confident that there will be a number of key achievements in the framework of this program, as the fight against corruption has been and continues to be one of the strategic priorities of the ALA.
Due to its high reliability, Iravaban.net, an independent professional news website founded by the ALA, has become an even more popular platform in the public and professional audiences for discussing public affairs and legal issues.
I should especially mention that all the achievements and the implementation of the ideas of the ALA are only possible thanks to the direct participation of the ALA’s close-knit team, its members and staff, volunteers and stakeholders in Yerevan and in the regions, partners and donors, to whom I want to express my deepest gratitude. I assure all of you that our joint work is appreciated and leads to desired results, which inspires us to continue working and creating with great enthusiasm.

INTRODUCTION

The ALA was founded in 1995 in Yerevan, during its activities it enjoys the public’s trust, it is an established structure in the field of law and civil society in the RA. Having a clear mission, vision, strategic action plan and values, the ALA successfully implements the tasks set before it and provides solutions to them.
One of the main activities of the ALA is the protection of human rights, including the protection of socially vulnerable groups and women’s rights, and raising the level of legal awareness, fighting corruption in Armenia, supporting justice and other targeted reforms, educating lawyers and promoting civil society.
In a short period of time, the ALA established business relations with a number of state, private and international organizations, implemented various programs aimed at implementing the main directions of the organization. The ALA currently has 5 branches: in Yerevan, and the provinces of Shirak, Lori, Gegharkunik and Syunik.
Since 2010 the ALA also operates the National Network of Anti-Corruption Centers (hereinafter referred to as the network). In 2013 the USAID decided to prematurely end the “Armenia against Corruption” project, as a result of which, on 1 February, 2014, the Network consolidated and anti-corruption centers started operating on voluntary basis. These are currently located in Yerevan and the provinces of Shirak, Lori, Gegharkunik and Syunik.
The ALA updates its legal library every year, the services of which are used by the lawyers of Yerevan and the provinces and other interested people. The ALA operates a trilingual official website: https://armla.am/, and the official website of the Network is: www.aac.am.
In 2018 the independent professional news website www.iravaban.net has been operated with high access rates in Armenian and English, it has more than 160000 followers on the social media website “Facebook.”

ALA’s MISSION, VALUES AND TEAM
- The Mission of the Armenian Lawyers’ Association is to develop a new generation of highly professional lawyers, having a modern outlook and moral values, as well as to promote the establishment of the rule of law and formation of legal culture in the society.
- The values of the organization are:

Modern legal culture rooted in the heritage of universal and Armenian centuries-old values,
A law-abiding, educated society, which is aware of its rights,
Protected human rights,
Lawyers with high professional knowledge and moral values,
A strong civil society.
- ALA’s Team.

The key to ALA’s success is its team. Professional specialists, who regularly improve their knowledge both in Armenia and abroad, make an invaluable contribution to the development and establishment of the structure, coming up with new initiatives and innovative ideas. The ALA regularly organizes events aimed at raising the professional qualities of its members, developing related skills, as well as a number of cultural events. The ALA team attaches great importance to the ideology and values of the structure and is always guided by them during its activities.

COOPERATION
- The ALA is constantly striving to expand the circle of its supporters and partners, while continuing close cooperation with its longtime partners. This year, the organization has implemented various anti-corruption and professional measures, acquiring new partners, including various non-governmental and international organizations, state bodies and business structures.
- Cooperation with the EU.

The EU funded “Commitment to Constructive Dialogue” project, which was launched on the 16^th December, 2016 with a duration period of 3 years continued to implement its goals throughout 2018. The project was implemented by the ALA (leading organization) in cooperation with the following partners: “Agora Central Europe” NGO (Czech Republic), Armenian Center for Democratic Education (CIVITAS), International Center for Human Development, SME Cooperation Association and the Union of Armenian Communities. The main goal of the project was to strengthen the influence of CSOs and CSO coalitions on the development of public policies in 9 target areas, and the specific objectives were to strengthen the ability of CSOs to build coalitions, their participation in public policy-making processes, identification of problems in the target areas and the development of appropriate policies and to focus on constructive and strategic policy engagement with local and central government partners.
Within the framework of EU cooperation, the “5th Eastern Partnership Business Forum” took place at the Austrian Presidency of the EU Council, at the Austrian Federal Economic Chamber, on 6th December 2018, Vienna, Austria, during which, ALA representative Mariam Zadoyan presented the activities of the Bizprotect.am website and indicators on consultations given to business representatives through the latter.
On 7 December in Vienna, the Austrian Presidency of the European Council hosted the first high-level annual Eastern Partnership (EaP) conference on the subject of “A stronger economy for stronger societies – Investing in people for sustainable growth”, which was attended by ALA representative Mariam Zadoyan.
- Cooperation with the Center for International Private enterprises (CIPE). Starting from the 1^st October, 2018, “Armenia: Promoting Anti-Corruption Conduct and Reforms” project was being implemented by the Center for International Private Enterprises, the Armenian Lawyers’ Association, the Corporate Governance Center and the Yerevan Chamber of Commerce and Industry. It was funded by the National Endowment for Democracy (NED). The duration of the project is 1 year: from October 2018 to October 2019. The budget for the project was $ 47,220, of which $ 41,970 was to be provided by the National Endowment for Democracy. The main goal of the program was to introduce Anti-Corruption Compliance Standards in Armenian businesses, which will contribute to dissemination of corporate governance and ethical values in Armenia.
- Cooperation with the Anti-Corruption network for Eastern Europe and Central Asia of the Anti-Corruption Network of the Organization for Economic Co-operation and Development (OECD). The 4^th round of the monitoring report of Armenia of the Istanbul Anti-Corruption Action Plan was presented to about three dozen representatives of the state and public sector, including the representatives of the Armenian Lawyers’ Association. The report includes the achievements and challenges of Armenia in the fight against corruption. Particularly, the development of public service and civil service legislation, legislative reforms in the field of ethics and conflict of interest, criminalization of illicit enrichment, the establishment of the Corruption Prevention Committee, the establishment of a whistleblowers’ system, the introduction of the beneficial owners institute in the procurement field. The meeting participants also discussed the implementation of recommendations assigned to Armenia as well as the new recommendations given to Armenia by the OECD Istanbul Anti-Corruption Action Plan.
- Cooperation with the OSCE Office, On 19 July, 2018, the mission headed by Paola Severino, the current OSCE Head’s Special Representative on Combating Corruption and Italy’s former Minister of Justice, had a meeting with some representatives of the Armenian Lawyers’ Association. Severino attached great importance to combating corruption and ALA’s consistent actions in this field.
- Cooperation with the International Society for Human Rights International Council. On 15 October, 2018, the ALA representatives hosted Mr. Thomas Schirrmacher, President of the International Society for Human Rights International Council and his colleagues. Schirrmacher highly appreciated the efforts of the organization aimed at protecting human rights, fighting corruption, and strengthening good governance. The parties discussed the main directions of cooperation as well. With the help of the ALA, Mr. Schirrmacher also met with the representatives of other civil society organizations.
- Cooperation with the organization Internationale de la Francophonie. On 12-14 September, 2018, Yerevan Marriott Hotel hosted the 11th Francophone International Non-Governmental Organization Forum, which was also attended by the ALA representative.
- Cooperation with the “Avocats Sans Frontières” International NGO. On 14 September, 2018, the Armenian Lawyers’ Association hosted Mr. François Cantier, the Founding President of the “Avocats Sans Frontières” International NGO and Mr. Arutine Muradyan Assistant Director of the organization. The “Avocats Sans Frontières” is a specialized structure in the field of human rights and access to court
- Cooperation in the framework of the 11th Black Sea Forum of Non-Governmental Organizations. The 11th edition of the Black Sea NGO Forum was held on 12 – 14 November, 2018, in Brussels, Belgium. More than one hundred non-governmental organizations took part in the Forum. Miss Susanne Soghomonyan, Board member of the “Armenian lawyers’ Association” participated in the event as well.
- Cooperation within the framework of the International Anti-Corruption Conference. The 18th International Anti-Corruption Conference (IACC), which will lasted from 22 to 24 October, started in Copenhagen, Denmark and was attended by Mr. Karen Zadoyan, President of the “Armenian Lawyers Association.” The broad agenda of the three-day conference includes plenary and panel discussions on the challenges and the most important anti-corruption mechanisms, including the principles of independent anti-corruption bodies, recovery of stolen assets as a result of corruption and other offenses, beneficial owners register, electronic innovation tools, social justice and etc.
- Cooperation with the CSO Anti-Corruption Coalition. The coalition continued its normal activities. The sessions of the Governing Board took place. The “Renewable Energy Producers’ Association’’ Union of Legal Entities and “Armavir Development Center” NGO joined the Coalition. The Third Conference of the CSOs’ Anti-Corruption Coalition of Armenia was held on 19 December, 2018, within the framework of an anti-corruption event dedicated to the International Anti-Corruption Day. During the conference, the report of the coalition’s activities for the period of 07.2017-31.10.2018 was presented, after which the coalition’s strategy for 2019-2023 was discussed and adopted.
- Cooperation with the RA Government.
The ALA has submitted its proposals and opinion on the Draft Decision of the Government on “Establishing an Anti-Corruption Council, Determining the Staff and Procedure of the Council”.
On 23 October, 2018 the working group of the Open Government Partnership (OGP) Initiative took place in the Government of Armenia, the agenda included the discussion of the 4^th OGP-Armenia Draft Action Plan. ALA’s legal experts also took part in the session. It is noteworthy that a number of working meetings and public discussions took place in September and October with the participation of Government, Civil Society and international experts aimed at developing the mentioned Action Plan. ALA’s and the coalition’s legal experts also took part in those meetings. The Coalition and the ALA proposed 7 recommendations, of which 3 were incorporated into the action plan, those are: the improvement of the asset and income declaration system submitted by public officials, establishment of a beneficial owners’ register, improvement of the transparency and participatory democracy in the local government.
The ALA, together with the Government, organized the first professional-expert in-depth and knowledge-based conference on the following subject: “The Possibilities of Introducing Mechanisms of Transitional Justice in the RA in the Light of International Experience”, which was also attended by the First Deputy Prime Minister of Armenia Ararat Mirzoyan.
- Cooperation with the RA National Assembly. As a result of the expert support of the “Commitment to Constructive Dialogue” project, the Armenian Association of Young Doctors and the Armenian Lawyers’ Association have long and reasonably argued about the problems of the new legislative regulations related to prescription drugs.. As a result of these regulations, there have been serious problems for doctors and patients in prescribing and purchasing medicines. The mentioned CSOs submitted a joint note to all factions of the National Assembly to hold parliamentary hearings on this issue. Meetings were also organized with the head of the NA Standing Committee on Health Care and Social Affairs and the representative of “Tsarukyan” Faction. As a result of these activities, Parliamentary hearings on the theme “Forms of Prescription, Writing Prescriptions, Ordering Medications, and Defining Medications and Pharmaceutical Records” were held on 26 March.
- Cooperation with the Traffic Police and “Xdrive” Auto-Motorsport school. The ALA and “Xdrive” Motorsport School made join suggestions for solving the problems of issuing a driver’s license. The traffic police sent a summary work titled “Detection of the Issues of Issuing a Driving License in the RA and the Submission of Proposals for Solutions.” Three working meetings were held with the participation of the traffic police, during which the possible changes in the theoretical and practical examinations of the process that are part of the issuance of driver’s licenses were discussed. The ALA has presented a number of proposals that should be put on legal footing in 2019.
- Cooperation with the State Revenue Committee. At the proposal of the ALA and 102 partner CSOs, the SRC Chairman’s February 13, 2018 Order No. 59-N has been complied with the requirements of the law and a CSO-SRC working group has been established, which, in 2019 will develop criteria for expanding accountability standards provided for in the law on “Non-Governmental Organizations.” The drafts developed by the working group will supplement and amend the existing regulations of the RA laws on “Non-Governmental Organizations” and “Foundations”, which are problematic in terms of legal certainty.

The ALA and the Coalition have submitted a proposal to install an automatic car customs meter on the SRC website, which has also been implemented. The official website of the State Revenue Committee has been operating the automatic calculator of car customs value since 10 April. From now on, any citizen preparing to import a car can know in advance what payments must be made. Within the framework of transparent activities, the State Revenue Committee makes the process of determining the customs value of cars more public, reliable and predictable, guided by the demand to meet the public interest in the process.

ALA PROJECTS AND IMPLEMENTED ACTIVITIES
- “Armenia: Promoting Anti-Corruption Conduct and Reforms” project

Under the framework of the “Armenia: Promoting Anti-Corruption Conduct and Reforms” project (hereinafter referred to as the Project”, which was launched on 1 October, small and medium sized enterprises in 4 Armenian provinces: Lori, Syunik, Gegharkunik and Shirak and Yerevan have joined the Project and filled in the “Role of Businesses in Fighting Corruption: Armenian Reality” questionnaire. The statistics of the questionnaires filled out by 75 companies in Yerevan, Gyumri, Vanadzor, Gavar and Kapan were summarized according to the type of entrepreneurial enterprise, the gender of the governing body of the organization, and the sphere of activity.
The Third International Corporate Directors Forum, organized by the Professional Corporate Governance Association (CGPA) and the International Finance Corporation (IFC), with the support of the Center for International Private Enterprise (CIPE) was held on 4 December in Kyiv. Mariam Zadoyan, Project Manager of the Armenian Lawyer’s Association (ALA) component of the “Armenia: Promoting Anti-Corruption Conduct and Reforms” Project, and Suzanna Soghomonyan, ALA board member, participated in the Forum. The goal of the forum was the familiarization of a wide range of specialists working in the field of corporate governance with the best practices of the independent directors’ work in companies and relevant aspects of international advanced corporate governance practices.
On 21 May, 2018, under the framework of the EU funded “Commitment to Constructive Dialogue” project, the workshop titled “the current Challenges of the Fight against Corruption and what to do next” was held. During the workshop there were speeches and discussions on the introduction of the Institute of criminalization of illicit enrichment and the Whistleblowing institute in Armenia, introduction of the institute of asset recovery in the fight against corruption and the possibility of its creation, the need to create an independent anti-corruption universal body, the need to separate business and politics, to ensure free economic competition, to fight against monopolies, and to establish the institute of beneficial owners.
On 19 December, 2018, an event dedicated to the International Anti-Corruption Day was held in the framework of the EU-funded “Commitment to Constructive Dialogue” Project. The RA Anti-Corruption Strategy 2019-2022 was discussed during the first part of the event. The participants of the event were informed that the ALA and the Coalition made 49 recommendations to incorporate in the RA Anti-Corruption Strategy, including the establishment of a universal anti-corruption body, establishment of the register of beneficial owners, recovery and restoration of the stolen assets, anti-corruption education, anti-corruption courts, introduction of anticorruption compliance programs in commercial companies, etc. Some of the recommendations have already been incorporated in the draft strategy, but there is still much to do.
On 19 December, the closing ceremony of the 2018 flow of Anti-Corruption School for Young Leaders took place. 8 young people presented reports on their research in the field of anti-corruption. They talked about the “Possibilities for returning the Stolen Assets to Armenia”, the “Whistleblowers System in Armenia: Current Problems and Development Tendencies”, “the Necessity for Introduction of the Institute of Beneficial Owners in Armenia”, “International Standards of the Capacity of Independent Anti-Corruption Bodies.”

The implementation of the EU funded “Commitment to Constructive Dialogue” project (hereinafter referred to as the Project.”[1]

Within the framework of the project, a collection of “100 questions and answers about the activities of non-governmental organizations” were published in a user friendly format, which is a brief guide to obtaining the necessary answers and decisions on a number of issues during the course of CSO activities.
On 18 September 2018, the first meeting of the “Commitment to Constructive Dialogue” (CCD) project Steering Committee took place. Members of the project consortium, the projects Steering Committee members and observers, representatives of the project sub-grantee coalitions, as well as Mr. Paulius Strelciunas, the CCD project task manager and an International Aid/Cooperation Officer at the Cooperation Section of the Delegation of the European Union in Armenia were present at the meeting.
Meetings with CSO representatives were held to discuss the progress, successes and difficulties of the projects implemented within the framework of the sub-grants provided within the framework of the project.
In 2018, during the implementation of their projects, CSOs met with representatives of various local self-government and state bodies, ministries, and international organizations to discuss vulnerable and targeted sectoral issues within the framework of their programs. The CSOs operating in the regions had meetings with the governors and local self-government bodies, as well as the networks formed in the regions, and their activities were presented to the relevant officials.
In 2018, within the framework of the CSO Incubator, seminars on “Public Budget and Policy Monitoring, Development of Evidence-Based Public Policies, Coalition Building, CSO-Government Dialogue.” were held in Yerevan, Vanadzor, Gyumri, Gavar and Kapan. Also among the CSO incubators, seminars on the Czech experience of developing Evidence-Based Public Policies were held, both in Yerevan and in the regions.
In 2018 Individual consultations on CSO public policy monitoring and improvement programs were provided in Yerevan and the provinces of Gegharkunik, Shirak, Lori and Syunik (in the cities of Gyumri, Vayk, Sisian, Goris, Kapan, Spitak, Stepanavan, Vanadzor, Dilijan, Ijevan, Chambarak, Gavar).
In 2018 courses of CSO incubator groups continued in Yerevan and the provinces of Gegharkunik, Shirak, Lori, Syunik. The courses were related to the topics of: Human rights: The need to constantly monitor threats against human rights activists, advocacy activities, capacity building, public monitoring, and social sphere: main issues of women’s employment and the protection of their labor rights in Armenia and other subjects.
On 27-31 August, in Aghveran, the 5-day seminar organized in the scope of the EU-funded” project and entitled“Cooperation of non-profit non-governmental organizations and government in the Czech Republic. Development of public policies and dialogue. Lessons learned from the operation of the incubators facility” took place.
On 31 July 2018, the Government-Civil Society Organizations’ Dialogue forum entitled “Current State and Development Prospects of Trade Unions’ was held, after which the ALA presented the summary of the forum and suggestions combined with international experience to the Ministry of Labor and Social Affairs and other interested parties.
On 13 November, the Armenian Lawyers’ Association, along with partner 102 non-governmental organizations and foundations, sent a statement to the SRC Head related to the Draft Laws on Making Additions and Amendments to the “Law of the Republic of Armenia on Non-Governmental Organizations” and the “Law of the Republic of Armenia on Foundations”. The statement was prepared and sent in the scope of the EU funded “Commitment to Constructive Dialogue” Project.
On 27 November 2018, the Inter-Regional Coalition to Deal with Issues of Children with Disabilities was formed in the scope of the “For Quality and Accessible Inclusive Education and Social Support”. Representatives of 33 coalition member organizations participated. The goal of the coalition is to contribute to the establishment of inclusive education in Armenia and advocacy of children with disabilities, increasing CSOs’ influence in the processes of developing and implementing public policies in this field.
The Civil Society-Government Forum entitled “The Possibilities of Introducing Mechanisms of Transitional Justice in the RA in the Light of International Experience”organized by the Armenian Lawyers’ Association in cooperation with the RA Government took place on 28 November, 2018, within the framework of the Project. Ambassadors of foreign states, high-ranking officials and representatives of RA state agencies, international organizations, civil society organizations, lawyers and experts participated in the event. The ALA has carried out extensive research on transitional justice, studying the experience of around 35 countries, both successful and failed cases. A report was published, which included both the study and the conference summary, which set out the recommendations, observations and considerations voiced during the conference. The report was submitted to state bodies, CSOs, published on the ALA website, as well as provided to other interested parties. Also awareness campaigns on transitional justice have been organized, presenting the 4 components of transitional justice in the form of infographics. Regularly conducted interviews by the experts, making informative videos, and disseminating them through the media were also effective. The results of the study will be summarized at the end of the conference, coordinating all proposals that will greatly assist the government and political forces in making final decisions on transitional justice.
On 30 November 2018, yet another meeting of the Agricultural Alliance took place at the Center for Agribusiness and Rural Development” (CARD) Foundation. The goal of the meeting was to present the results of some activities implemented by the Alliance within the “Participatory Policies – Sustainable Agriculture” project, as well as to discuss the work aimed at strengthening the Alliance.
On 20 December 2018, a discussion-seminar in the scope of the “New Strategy for the Efficient Development of the SME Sector of Armenia” dedicated to the draft law on making changes and additions in the Tax Code and the new strategy of the SME sector development took place. The rules and regulations and the rotation order of the governing board chairman of the Armenian Business Coalition were presented and approved at the event. Then, the memorandum of the establishment of the coalition was signed. 27 civil society organizations having business membership and supporting business interests united efforts in the Armenian Business Coalition.
On 28 December, the Project team and Member Organizations of the Project Consortium held their annual meeting. During the meeting, the results of the 2nd year (2018) of the CCD Project were presented and summarized. Also on 31 May, 2018, 9 sub-grants worth 25 million AMD each were provided within the framework of the 9 CSO coalition programs for implementation of projects in the target sector of the CCD project (about 225 million AMD). 7 CSO coalitions, which have already been awarded sub-grants by CCD, were also awarded with sub-grants of up to 8.5 million AMD each for their capacity development. The actions envisaged within the framework of the Program during the next year were also addressed. 2 more sub-grants will be provided to the CSO Coalitions (about 17 million drams) at the beginning of next year. It was also mentioned that civil society organizations (CSO) incubators were formed in Yerevan, Gyumri, Vanadzor, Gavar and Kapan within the framework of the project aimed at promoting the capacity building of CSOs and enhancing their effectiveness. In 2018, the CSO incubators member organizations were provided on a competitive basis with a total of 29 sub-grants of up to 5.5 million AMD each. The activities planned for the third year of the project were presented at the annual meeting as well.
The 29 sub-grants[2] issued on 27 December, 2018, are mainly aimed at the implementation of programs in different communities of the country. By cooperating with the government and local governments and influencing public policies, CSOs need to reach changes. And the grants to the coalitions will strengthen the capabilities of the newly formed or already existing coalitions to such an extent that they will be more influential in developing policies and constructive dialogue with the government.
The number of NGOs that applied for support in the framework of the Project in the period of January to December 2018, is as follows:
- Yerevan: 167 NGOs applied for consultations, 268 NGOs were provided with consultations, 16 CSOs were re-registered, 10 new NGOs were registered, 58 charters were developed,
- Gyumri: 13 NGOs applied for consultations, 38 NGOs were provided with consultations, 17 CSOs were re-registered, 11 new NGOs were registered, 5 charters were developed,
- Kapan: 13 NGOs applied for consultations, 69 NGOs were provided with consultations, 7 CSOs were re-registered, 3 new NGOs were registered, 1 charter was developed,
- Gavar: 120 NGOs applied for consultations, 267 NGOs were provided with consultations, 8 CSOs were re-registered, 5 new NGOs were registered, 1 charter was developed,
- Vanadzor: 12 NGOs applied for consultations, 62 NGOs were provided with consultations, 16 CSOs were re-registered.
