Within the framework of the “ALA for Modernization” Project, the “Armenian Lawyers’ Association” non-governmental organization has initiated the provision of legal advice to the public on a number of legal issues related to the state of emergency. The first question and answer session prepared by our legal team referred to 9 measures to neutralize economic consequences, their main regulations, as well as the rights of employees during the restrictions imposed as a result of the pandemic, and the problems that arose.
This second series of questions and answers, which aims to inform the public, to address the restrictions imposed during the state of emergency and the legislative regulations of the adopted normative legal acts, refers to the anti-crisis programs No. 11, 12 and 13 adopted by the Government of the Republic of Armenia.
The answers to the questions were based on the current legislation as 18 of April, 2020.
Anti-crisis program N 11
Question 1: Who are the beneficiaries of the eleventh program of neutralization of the economic consequences of the coronavirus?
Answer: Beneficiaries of the measure are the residents/subscribers who have signed contract of the natural gas supply and electricity supply, whose expenses for February 2020 did not exceed:
1) 10,000 drams for natural gas consumption,
2) 5,000 drams for electricity consumption.
Support is provided by each subscriber benefiting from this event at a rate of 50% of the natural gas and electricity costs consumed in February 2020, respectively.
The total amount determined in accordance with this measure shall be transferred to the natural gas and electricity supply companies on the condition of further transfer to the resident customers who are considered to be the beneficiaries of the measure. Moreover, in case of debt, this amount is directed to the repayment of the debt of the resident subscriber, and in case of its absence, it is formulated as a prepayment.
Anti-crisis program No 12
Question 1: Who are the beneficiaries of the twelfth program to neutralize the economic consequences of the coronavirus?
Answer: Beneficiaries of the measure are the residents/subscribers who have signed contract of the natural gas supply and electricity supply, whose expenses for February 2020 did not exceed:
1) 10 001-30 000 AMD including for natural gas consumption,
2) 5 001-10 000 AMD including for electricity consumption,
Support is provided by each subscriber who benefits from this event at a rate of 30% of the natural gas and electricity costs consumed in February 2020, respectively.
The total amount determined in accordance with this measure shall be transferred to the natural gas and electricity supply companies on the condition of further transfer to the resident customers who are considered to be the beneficiaries of the measure. Moreover, in case of debt, this amount is directed to the repayment of the debt of the resident subscriber, and in case of its absence, it is formulated as a prepayment.
Anti-crisis program N 13
Question 1: Who are the beneficiaries of the thirteenth program to neutralize the economic consequences of the coronavirus?
Answer: Beneficiaries of the event are the families entitled to family and social benefits as of April 2020.
Support is provided to each family beneficiary of this event at a rate of 50% of their benefit, which includes:
1) 70% is provided to the family by cash payment, together with the payment of the April benefit,
2) 30% is transferred as a payment for the electricity consumed by the subscriber, and in case of a beneficiary’s not being a subscriber, the amount is provided to the beneficiary in the manner defined by sub-clause 1 of this clause (cash payment).
The amount provided for this event is transferred to the electricity supplier in the name of the beneficiary family of each subscriber. At the same time, in case of the beneficiary’s debt, that amount is directed to the repayment of the debt of the resident subscriber, and in case of its absence, it is formulated as a prepayment.
