In the Anti-Corruption School of Young Leaders discussed the Types of Corruption-Related Crimes

During the regular lesson of the Anti-Corruption School for Young Leaders, the participants discussed the types of corruption-related crimes.

Mr. Arnold Vardanyan, Chief Specialist of the Legal Expertise Service of the Court of Cassation, Post Graduate Student at the Law Faculty of YSU, who at the same time is the graduate of the first stream of the Anti-Corruption School for Young Leaders, presented the peculiarities of the criminal-law qualification of crimes of corrupt nature and spoke about the current problems.

The speaker in detail touched upon the peculiarities of the crime of illicit enrichment, money laundering, bribery and extortion, presenting the judicial practice, the case-law of the Court of Cassation, the legal positions expressed by the Constitutional Court and the European Court of Human Rights.

Arnold Vardanyan also presented to the audience the correlation between the presumption of innocence and the legal presumption of facts, touched upon theoretical and practical approaches to the burden of proof of the person’s guilt in the criminal proceedings.

At the end of the lesson, the speaker discussed with the audience the criminal law peculiarities of the act of “alleged mediator” for qualifying it as inducing to bribe-giving and fraud.
