The Armenian Lawyers’ Association, in cooperation with the Armenian CSOs’ Anti-Corruption Coalition, conducted a study aimed at preventing torture and other cruel, inhuman or degrading treatment or punishment in the scope of cooperation between the RA Prosecutor’s Office and the Armenian Lawyers’ Association,
There are a number of key issues in the study that are analyzed through international and national legal acts.
The authors of the study suggest to ensure at the legislative level the right of a person to be subjected to medical examination at the initial stage of the seizure, as well as guaranteeing the electronic registration of the person at the time of deprivation of liberty, and reasonably and in justified manner initiate a criminal proceedings on torture, cruel, inhuman, degrading treatment or punishment at the time of the receipt of information, provide that the process of investigative actions against the deprived of liberty person, the suspect or the accused is carried out with the participation of the defendant is subject to compulsory video recording and, to establish at the end that the summary trial is prohibited in cases where a preliminary investigation of the criminal case or evidence or the defendant’s appearance indicates that the defendant was subjected to torture, cruel, inhuman or degrading treatment.
On 16 December, the Armenian Lawyers Association presented the study to the RA General Prosecutor’s Office.
