In 2020, they enrolled in a military educational institution in the Republic of Armenia to continue their education. Their presence in the Republic of Armenia was exclusively due to educational obligations and was temporary, as they intended to continue their military service in Artsakh after completing the educational programme.

However, due to the blockade of Artsakh, the closure of the Lachin Corridor, and the subsequent forced displacement, their return to Artsakh had become objectively impossible. Meanwhile, their parents were persons forcibly displaced from Artsakh and had already been included in the State Housing Support Programme.

Despite these circumstances, the applicant’s applications had been rejected without a comprehensive assessment of their factual ties to Artsakh, their family’s status, or the actual reasons for their presence in the Republic of Armenia.

After reviewing the application, the legal team of the Armenian Lawyers’ Association conducted a comprehensive examination of the facts presented and the applicable legal framework.

The examination established that a comprehensive and individualised assessment of the person’s circumstances was necessary, taking into account their factual ties to Nagorno-Karabakh, the actual purpose of their presence in the Republic of Armenia, their family’s status, and the objective circumstances that had arisen.

The ALA legal team prepared and submitted a substantiated letter to the Ministry of Labour and Social Affairs of the Republic of Armenia, requesting a review of the rejection decision concerning E. Musayelyan and an additional examination of the case.

The legal position presented emphasised that, in such cases, the assessment should not be based solely on the person’s formal place of residence. Instead, all material factual and legal circumstances of the case must be taken into account to ensure an individualised approach consistent with the objectives of the social support programme.

As a result, on the basis of the legal arguments presented and the additional examination of the case, the matter was referred for consideration to the interagency commission established under the procedure set out in Government of the Republic of Armenia Decision No. 710-L of 16 May 2024. The commission examines individual cases of families who applied to the State Housing Support Programme for Families Forcibly Displaced from Nagorno-Karabakh but were not granted beneficiary status.

At its meeting on 30 June 2026, the commission considered the application and adopted a positive decision.

As a result, E. Musayelyan was included in the list of beneficiaries of the State Housing Support Programme for Families Forcibly Displaced from Nagorno-Karabakh.

This case demonstrates that effective legal assistance can play a significant role in protecting individuals’ rights, overcoming legal barriers, and ensuring the effective exercise of those rights.

Musayelyan, a person forcibly displaced from Nagorno-Karabakh, applied through the online legal assistance platform armrights.am, operated by the Armenian Lawyers’ Association NGO, requesting assistance in obtaining beneficiary status under the State Housing Support Programme for Families Forcibly Displaced from Nagorno-Karabakh.
