{"id":8161,"date":"2024-02-14T09:58:39","date_gmt":"2024-02-14T05:58:39","guid":{"rendered":"https:\/\/armla.am\/en\/?p=8161"},"modified":"2024-02-14T09:58:39","modified_gmt":"2024-02-14T05:58:39","slug":"fairness-is-the-moral-component-of-the-category-of-justice-and-trial-is-the-legal-component-karen-zadoyan","status":"publish","type":"post","link":"https:\/\/armla.am\/en\/8161.html","title":{"rendered":"Fairness is the Moral Component of the Category of Justice and Trial is the Legal Component: Karen Zadoyan"},"content":{"rendered":"<p style=\"text-align: justify\">On 9 February, Prime Minister Nikol Pashinyan\u00a0expressed the following in his\u00a0<a href=\"https:\/\/www.primeminister.am\/hy\/press-release\/item\/2024\/02\/09\/Nikol-Pashinyan-Constitutional-Court\/\">speech<\/a>\u00a0at the event dedicated to the 28th anniversary of the establishment of the Constitutional Court. \u201cJustice is an institution, and fairness is a feeling.\u201d<\/p>\n<div id=\"native_network_ad_1\" style=\"text-align: justify\"><\/div>\n<p style=\"text-align: justify\"><a href=\"https:\/\/iravaban.net\/en\" target=\"_blank\" rel=\"noopener\"><strong><em>Iravaban.net<\/em><\/strong><\/a>\u00a0turned to Mr. Karen Zadoyan, President of the Armenian Lawyers\u2019 Association, asking to comment on the thought expressed by the head of the executive.<\/p>\n<div id=\"nativeVideo\" style=\"text-align: justify\"><\/div>\n<p style=\"text-align: justify\">In response, the ALA President stated that everyone, including the Prime Minister of the country, is free to express thoughts about justice and fairness, and he is not going to comment on them.<\/p>\n<div id=\"native_network_ad_2\" style=\"text-align: justify\"><\/div>\n<div id=\"adfox_168715407287951942\" style=\"text-align: justify\"><\/div>\n<p style=\"text-align: justify\">However, Karen Zadoyan presented his idea about the category of \u201cjustice\u201d.<\/p>\n<p style=\"text-align: justify\">\u201cThe category of justice is made up of two different but balanced components: justice and trial. Justice is a component of the moral aspect, and the trial is a component of the legal aspect, without their harmonious combination, real justice cannot be realized.<\/p>\n<p style=\"text-align: justify\">For example, if a judge is proficient in substantive and procedural law, but is not honest and lacks integrity, he will deliver a subverted justice. And in the contrary, if a judge is honest and adhers t integrity values, but does not have a professional knowledge of substantive and procedural law, he will also deliver a subverted justice.<\/p>\n<p style=\"text-align: justify\">There is only one way out: harmonious co-realization of the moral and legal balance of the components of true justice.<\/p>\n<p style=\"text-align: justify\">When true justice is implemented, as a result, citizens find justice in their own country.
