{"id":7291,"date":"2022-02-01T18:48:00","date_gmt":"2022-02-01T14:48:00","guid":{"rendered":"https:\/\/armla.am\/en\/?p=7291"},"modified":"2022-02-02T12:48:53","modified_gmt":"2022-02-02T08:48:53","slug":"notary-advocacy-bankruptcy-and-compulsory-enforcement-systems-focus-group-discussion-within-the-framework-of-the-legal-and-judicial-reform-strategy","status":"publish","type":"post","link":"https:\/\/armla.am\/en\/7291.html","title":{"rendered":"Notary, Advocacy, Bankruptcy, and Compulsory Enforcement systems: Focus Group Discussion within the Framework of the Legal and Judicial Reform Strategy"},"content":{"rendered":"<p style=\"text-align: justify\">Today, on 1 February, the\u00a0 11th and 12th focus group discussions, on the 14th, 15th, 16th, 17th and 18th actions regarding the law enforcement system of the Action Plan stemming from the 2019-2023 Judicial and Legal Reform Strategy were held on the initiative of the Armenian Lawyers\u2019 Association.<\/p>\n<p style=\"text-align: justify\">The first of the discussions was held with the participation of representatives of the Ministry of Justice, the Armenian-Russian University, the Bankruptcy Administration system, and the Armenian Lawyers\u2019 Association.<\/p>\n<div id=\"inpage_VI-258336-0-952357372\" class=\"inpage_adf\" style=\"text-align: justify\"><\/div>\n<div id=\"caramel_interscroller\" style=\"text-align: justify\"><\/div>\n<p style=\"text-align: justify\">The second discussion was held with CSOs and representatives of the legal community.<\/p>\n<p style=\"text-align: justify\">It should be noted that\u00a0<strong>Goal 14<\/strong>\u00a0envisages increasing the efficiency of the Bankruptcy System.<\/p>\n<p style=\"text-align: justify\">The strategic directions of this goal are:<\/p>\n<ul style=\"text-align: justify\">\n<li>Improving the procedures for acquiring the profession of bankruptcy administrators, including a toolkit for increasing the effectiveness of liability and activities.<\/li>\n<li>Establishing sustainable mechanisms contributing to financial recovery.<\/li>\n<li>Enhancing the role of judges (courts) in bankruptcy proceedings.<\/li>\n<li>Raising public awareness about the bankruptcy system.<\/li>\n<li>Elaborating a universal bankruptcy legislation.<\/li>\n<li>Review and improvement of regulations relating to debtor\u2019s property inventory, assessment and sale.<\/li>\n<li>Increasing the role of creditors, judges (court) in the bankruptcy proceedings.<\/li>\n<\/ul>\n<p style=\"text-align: justify\"><strong>Goal 15<\/strong>\u00a0envisages the development of alternative dispute resolution means, including \u2024<\/p>\n<div id=\"ca_wrapper_19811750\" class=\"outstream-outer\" style=\"text-align: justify\"><\/div>\n<div id=\"adfox_162262523031274001\" style=\"text-align: justify\"><\/div>\n<ul style=\"text-align: justify\">\n<li>Establishment of Arbitration Centers.<\/li>\n<li>Developing other alternative methods of dispute settlement.<\/li>\n<li>Raising the level of relevant legal education and public awareness.<\/li>\n<li>Improving the arbitration legislation.<\/li>\n<\/ul>\n<p style=\"text-align: justify\"><strong>Goal 16<\/strong>\u00a0envisages increasing the effectiveness of the Notary System.<\/p>\n<p style=\"text-align: justify\">In particular, it is envisaged<\/p>\n<ul style=\"text-align: justify\">\n<li>Improving the institute of a notary writ execution.<\/li>\n<li>Review of the procedure for subjecting a notary to disciplinary liability.<\/li>\n<li>Increasing the effectiveness of notarial actions.<\/li>\n<\/ul>\n<p style=\"text-align: justify\"><strong>Goal 17\u00a0<\/strong>envisages increasing the effectiveness of the Advocacy System. It is envisaged:<\/p>\n<ul style=\"text-align: justify\">\n<li>Broadening the scope of beneficiaries of free legal aid.<\/li>\n<li>Developing alternative mechanisms of providing free legal aid.<\/li>\n<li>Increasing the efficiency of Public Defender\u2019s activities.<\/li>\n<li>Developing the activities of the School of Advocates.<\/li>\n<li>Improving the rules of conduct and integrity of advocates.<\/li>\n<li>Development internal mechanisms of the Chamber of Advocates.<\/li>\n<\/ul>\n<p style=\"text-align: justify\"><strong>Goal\u00a0<\/strong><strong>18<\/strong>\u00a0refers to the reforms of the Compulsory Enforcement system.
